What is the European Union's Artificial Intelligence Act (“EU AI Act”)?

The EU AI Act is a regulation that aims to ensure artificial intelligence systems (“AI”) are trustworthy, transparent, and respect individual and societal rights. Under the EU AI Act, AI is classified according to risk and categorized as prohibited AI, high risk AI, or other AI (formerly known as minimal and limited risk AI, which is neither prohibited AI or high-risk AI). The EU AI Act (i) prohibits AI classified as prohibited AI, (ii) has obligations with respect to high-risk AI, and (iii) has some transparency requirements for other AI where applicable.

  • Document Automation – Extract, embed, and transfer data from documents into other systems using computer vision and generative AI. Customers have the choice of provider/model from a list which we provide, or customers can bring their own model license, so long as it matches a model on our list.
  • AI Agent Studio (a BYOL (as defined herein) product) - empowers developers of all levels with low-code tools to easily build, manage, and govern custom enterprise AI Agents. Developers can start with the foundational model of choice, including models from AWS, Google Cloud, and Microsoft Azure OpenAI Service and more.
  • Process Discovery – machine learning which runs in the background on a user’s virtual desktop and records actions to identify business processes capable of being automated.
  • Automator AI – a comprehensive set of generative AI products and capabilities to accelerate the automation lifecycle, making it faster and easier to build, deploy and manage automations. Key innovations include:
    • Autopilot – takes the output from Process Discovery and assists customers with creating bots for automating business processes. Enables cross-functional teams to go from discovery to automation in record time by quickly converting process documentation into draft process automation using generative AI.
    • Automation Co-Pilot for Automators – enables non-technical users to create automations using natural language.
    • Generative Recorder – enables teams to build more resilient user interface (“UI”) automations with a generative AI fallback that automatically detects changes in a source application interface and self-heals in real-time to keep work moving.
  • Enterprise Knowledge – our Retrieval-Augmented Generation (“RAG”) product.

Do customers have the option to integrate their own AI vendor (aka: Bring Your Own License or “BYOL”) with Automation Anywhere products?

Yes, customers can bring their own AI models to integrate with the following: bots, AI Agent Studio, Document Automation, and Automation Co-Pilot.

Under which EU AI Act classification are the AI features which Automation Anywhere offers to customers?

Automation Anywhere’s AI features and offerings where Automation Anywhere provides the AI functionality fall under the “other AI” category.

Customers will need to independently assess the EU AI Act classification for AI where they bring their own AI and integrate it with Automation Anywhere products, or where they determine the data to submit to the AI or the purpose of processing/decision making level of the AI.

What EU AI Act obligations are the responsibility of the Customer vs Automation Anywhere?

Automation Anywhere has the obligation to (i) provide technical documentation to customers providing instructions on the use of AI, and (ii) be transparent as to when AI is used to process customer data. Where Automation Anywhere trains AI for a specific purpose, provides the trained AI to a customer, and determines the purpose of the use of AI, Automation Anywhere is responsible for the training data used to train the AI.

Customers will be responsible for training, accuracy, AI assessments, monitoring, labeling, transparency, and any additional obligations under the EU AI Act where customers bring their own AI and integrate or connect the AI to an Automation Anywhere product, or where customers determine the data which they will send to AI, the function AI will perform, or whether AI will make a decision based off data. Automation Anywhere does not have enough insight into customers’ use of the AI to perform these functions on behalf of customers. Automation Anywhere will collaborate with customers on information relating to Automation Anywhere products and their functionality in order to assist customers with any assessments to the extent necessary for customers to comply with the EU AI Act.
